Son of former NFL player, reality TV star faces sexual battery, sodomy charges

FULTON COUNTY, Ga. - The 15-year-old son of former Atlanta Falcons player Kroy Biermann and former Real Housewives of Atlanta star Kim Zolciak is facing several felony charges following an incident in Alpharetta. 

Kroy "KJ" Biermann Jr. charged

What we know:

According to arrest warrants filed in Fulton County Magistrate Court, Kroy Biermann Jr., known as "KJ," has been charged with felony aggravated sodomy and felony aggravated sexual battery. 

The Alpharetta Police Department confirmed he is being charged as an adult. 

Life Time Fitness Incident

Investigators with the Alpharetta Police Department stated in an incident report that the charges stem from an incident reported on April 23 in the family changing area of a Life Time Fitness located on North Point Parkway.

Authorities allege Biermann Jr. met a 15-year-old acquaintance in the facility's café before leading her into the family changing area. The victim reported to police that Biermann Jr. physically restrained her, engaged in unwanted sexual contact and forced her to engage in sexual acts against her will. 

Following the reported encounter, the victim was evaluated by a Sexual Assault Nurse Examiner at Children's Healthcare of Atlanta, where a sexual assault kit was completed. 

According to an arrest warrant filed in Fulton County Magistrate Court, tests on the alleged victim did not reveal any male DNA on her.

Court documents state that he was arrested on Monday, Aug. 17. 

Kim Zolciak's statement to TMZ

In a statement posted on TMZ.com, Zolciak said, "The allegations being made against my son are nothing short of reckless and deeply troubling. He categorically denies ever being involved with this woman or engaging in the conduct she has alleged." The mother adds her son "voluntarily took a polygraph examination regarding these allegations and passed." FOX 5 has reached out to Zolciak independently. 

What we don't know:

It's unclear if he could face additional charges in the case. 

Neither Biermann Jr. nor his defense team have issued a public statement addressing the allegations. 

It is unclear if Kroy Biermann Sr. has publicly commented on his son's arrest or legal proceedings.

The 15-year-old will face a Fulton County Superior Court judge in September, who will handle pre-trial court proceedings.
